A legal battle over equal pay for disabled workers in Germany is escalating, drawing attention from the UK’s Equality and Human Rights Commission. The case, brought by a group of employees in sheltered workshops, argues that they receive significantly lower wages than non-disabled counterparts performing similar roles. German law currently permits exemptions from minimum wage requirements for workers with disabilities under certain conditions.
The complainants contend this violates EU equality directives and the UN Convention on the Rights of Persons with Disabilities. The UK watchdog is monitoring the case closely as it could set a precedent for similar claims within its jurisdiction. The German Federal Labour Court is expected to issue a preliminary ruling next month, with the final decision potentially reaching the European Court of Justice.
